Returns policy
Product returns policy pursuant to Articles 52 et seq. of Italian Legislative Decree no. 206 of 6 September 2005, as amended and supplemented (Consumer Code)
1. Scope
This section governs the terms, procedures and conditions for exercising the right of withdrawal granted to the user-consumer in relation to purchases made on the website www.bselfie.it of Youderma S.r.l., with registered office in Milan (MI), Viale Luigi Majno 5, Tax Code and VAT number 14304020960, REA number MI–2773213 (the "Company" or "Youderma"), in accordance with the provisions of Italian Legislative Decree no. 206 of 6 September 2005, as amended and supplemented (Consumer Code). The provisions set out below apply exclusively to contracts for the purchase of products marketed by Youderma S.r.l. ("Products") concluded at a distance through the website www.bselfie.it between the Company and the user-consumer, meaning the natural person acting for purposes unrelated to any business, commercial, craft or professional activity they may carry out.
2. Right of withdrawal: time limit and procedure
2.1 Time limit for exercising the right of withdrawal
Pursuant to Art. 52, paragraph 1, of the Consumer Code, the user-consumer has the right to withdraw from the purchase contract within 14 (fourteen) days, without giving any reason.
The 14-day period for exercising the right of withdrawal runs:
(i) in the case of the purchase of a single product, from the day on which the user-consumer, or a third party designated by them other than the carrier, receives the product;
(ii) in the case of the purchase of several products in a single order with separate delivery, from the day on which the user-consumer receives the last product.
The right of withdrawal is deemed to have been exercised within the time limit if the relevant communication is sent by the user-consumer before the withdrawal period expires.
2.2 Procedure for exercising the right of withdrawal
The user-consumer may exercise their right of withdrawal within the above time limit by sending a communication to the Company before the 14-day period expires: by e-mail to info@bselfie.it, stating the consumer's first name and surname, the order number and date, the date of receipt of the products and the products they wish to return.
Pursuant to Art. 54, paragraph 3, of the Consumer Code, the Company will send confirmation of receipt of the withdrawal by e-mail without delay.
3. Exclusions from the right of withdrawal and sealed cosmetic products
Pursuant to Art. 59, paragraph 1, letter e), of the Consumer Code, the right of withdrawal is excluded for the supply of sealed products which are not suitable for return for hygiene or health protection reasons and which have been opened after delivery. More precisely, the right of withdrawal is excluded:
-for cosmetic Products sold by the Company in sealed packaging, i.e. Products supplied with a protective seal (film, wrapping, blister or other protection system), where the seal has been removed, opened or altered after delivery;
in such cases, the Company will not be able to accept the return of the product or refund the price paid. For Products without a protective seal, the right of withdrawal remains fully exercisable within the time limits set out in Article 2 above.
For textile garments the consumer may exercise the right of withdrawal; the consumer remains liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning, as better specified in Art. 4.4.
Products must be returned in a normal state of preservation. For sealed products falling under Art. 59, paragraph 1, letter e), opening the seal results in the loss of the right of withdrawal.
4. Obligations of the user-consumer: return of the products
4.1 Return time limits
Following the communication of withdrawal, the user-consumer must return the Products to the Company without delay and, in any case, within 14 (fourteen) days from the date on which they communicated their decision to withdraw from the contract. The time limit is deemed to have been met if the goods are sent back by the user-consumer before that period expires.
4.2 Return procedure
Products must be returned to the following address: Youderma S.r.l., Ufficio Resi, Via Fratelli di Dio 5, 20037, Paderno Dugnano (MI), Italy. It is understood that until delivery to the Company, responsibility for the products remains with the user-consumer.
4.3 Return costs
Pursuant to Art. 57, paragraph 1, all costs of returning the Products are borne by the user-consumer.
4.4 Condition of the returned Products
The user-consumer has the right to examine the Products to establish their nature, characteristics and functioning, handling them with due care and in the same way as they would be allowed to do in a physical shop.
Pursuant to Art. 57, paragraph 2, of the Consumer Code, the user-consumer is liable only for any diminished value of the Products resulting from handling other than what is strictly necessary for that purpose.
In particular:
• For textile garments, trying them on to check size and fit is permitted, but not use, washing or any treatment that alters their original condition.
• Products must be returned intact, in a normal state of preservation, complete with all their parts, original packaging, labels and any accessories.
If, upon assessing the return, the Company finds a diminished value attributable to unnecessary handling, it may deduct from the refund an amount corresponding to that diminished value.
It is reiterated that for sealed cosmetic Products, opening the protective seal results in the loss of the right of withdrawal, regardless of the extent of actual use.
5. Obligations of the Company: refund
In the event of valid exercise of the right of withdrawal, and subject to any deduction resulting from diminished value due to handling or alteration of the Products, the Company will refund all payments received from the user-consumer without undue delay and in any case within 14 (fourteen) days from the day on which it is informed of the consumer's decision to withdraw from the contract, using the same means of payment used by the user-consumer for the initial transaction.
Pursuant to Art. 56, paragraph 3, of the Consumer Code, the Company may withhold the refund until it has received the returned products, or until the user-consumer has supplied evidence of having sent back the products, whichever is the earliest.
